Criminal Appeals

My practice is dedicated to providing quality representation to those who have been convicted of criminal offenses.   A criminal appeal is basically a review of the trial to determine whether any errors occurred.   Normally, the only issues the appellate court will consider are those concerning the legal rulings of the trial court.  In other words, the appellate court will review any rulings made by the trial judge to determine they were correct.  New evidence cannot be admitted during the appeal.  The court is limited to the written record of the trial and errors which are preserved for appellate review.   Normally an objection during trial is required to preserve an issue for appellate review.  An appellate court's review of fact issues presented at trial is extremely limited.  A court of appeals does not decide guilt or innocence. Except in extreme cases, the appellate court will not review the jury's verdict of guilty to determine whether the court thinks the verdict is correct and the court will not consider whether certain witnesses were truthful when they testified.
